Can a Notary Public notarize my Employment Form (Form I-9)?
California Notaries who are not qualified and bonded as immigration consultants under the Business and Professions Code Sections 22440-22449, may not complete or make the certification on Form I-9, even in a non-notarial capacity. The Secretary’s office considers Form I-9 to be an immigration form. Any California Notary who is not an immigration consultant violates Government Code Section 8223(c). -NNA

Can a Notary Public sign as a witness on my legal documents?
A Notary Public is an impartial California appointed official that should only witness the signing of legal documents and confirm identities. Notary Public's should not sign legal documents as witnesses to maintain impartiality and reduce conflicts of interest.
Can a Notary offer legal advice or provide legal documents?
No. California law prohibits any Notary Public from providing legal advice, or supplying documents, which can be construed as offering legal advice.
**Please be advised that all Clients are responsible for paying Notary travel fees, specifically in situations where the Client misses the scheduled appointment, is unable to furnish one or two Credible Witnesses or an acceptable form of identification as prescribed by the CA Secretary of State.
